Golden State gets favorable court ruling against F.L.O.W.

A motion by Golden State Water Company (GSWC) to prevent Ojai Friends of Locally Owned Water (Ojai F.L.O.W.) from recovering damages was granted Oct. 25 in Ventura County Superior Court. F.L.O.W. does not have appropriate standing, the motion contends, for bringing such an action against GSWC.
In July, Ojai F.L.O.W. filed for damages resulting from litigation filed by GSWC to block its acquisition by the Casitas Municipal Water District (CMWD). Its suit was attached to CMWD's ongoing eminent domain litigation for the acquisition of the Ojai District. GSWC responded with a special motion, filed under the California anti-SLAPP (Strategic Lawsuit Against Public Participation) statute, arguing the plaintiffs cannot hold GSWC civilly liable for GSWC's constitutional right to petition the government.
