Ojai Playhouse owner Khaled Al-Awar's lawsuit against the Golden State Water Company (GSWC) goes to trial May 17.
Filed Nov. 13, 2015, the complaint cites four causes of action — inverse condemnation, nuisance, trespass and negligence — contending GSWC's responsibility for completing the repairs.
The 100-year-old Playhouse building, which also housed the Jester bar and restaurant, received extensive structural damage resulting from the 2014 rupture of a water main operated by GSWC. The subsequent repair was being underwritten by Golden State, whose initial insurance carrier's policy reached its maximum in January 2015, at which time GSWC's secondary insurance carrier took over and all work on the building came to a halt.
For much of 2015, the insurance company, GSWC and Al-Awar conducted a series of negotiations over payments for repairs.
Open to the public, the trial is set to convene at 8:30 a.m. in Ventura Superior Court, 800 S. Victoria Ave. in Ventura. The trial has been scheduled to conclude no later than June 2, according to attorney John Howard, who represents Al-Awar in the litigation.
