City joins short-term rental suit

The Ojai City Council approved a request from City Manager Steve McClary and City Attorney Matthew Summers May 22 to join a League of California Cities amicus brief supporting the city of Santa Monica in its legal battle against Homeaway.com, Inc. and Airbnb, Inc.
Santa Monica adopted an ordinance in 2015 that prohibited unhosted vacation rentals while regulating hosted vacation rentals within the city. The ordinance also prohibited websites such as Airbnb and Homeaway from advertising rentals the city deemed unlawful.
The city of Ojai began enforcing its own prohibition against all short-term vacation rentals in the city in 2016.
Following legal challenges, Santa Monica officials amended their short-term rental ordinance in 2017 to prohibit platforms like Airbnb and Homeaway from completing transactions involving unlicensed or prohibited vacation rentals, according to a staff report authored by McClary and Summers.
